These Terms of Use govern your use of the GardenGenius app and website. By downloading or using GardenGenius, you agree to these terms. Please read them — they're written to be understood, not to confuse you.
GardenGenius uses AI-powered image recognition to identify plants and diagnose conditions. While our models are highly accurate, identification results are not guaranteed to be 100% correct. Never consume, touch, or use a plant based solely on an AI identification. If you suspect a plant is poisonous or you experience a reaction, contact a poison control center or medical professional immediately.
1. Eligibility
You must be at least 13 years old to use GardenGenius. By using the app, you confirm you meet this requirement. If you are under 18, you should have a parent or guardian review these terms.
2. Your account
Creating an account is optional. If you create one, you are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at support@gardengenius.app.
3. Subscription and payments
GardenGenius offers a free tier and a premium subscription. Subscriptions are billed through the Apple App Store. By purchasing a subscription, you agree to Apple's payment terms. Subscription fees are clearly displayed before purchase. You may cancel your subscription at any time through your iPhone's App Store subscription settings. Cancellation takes effect at the end of your current billing period — you retain access to premium features until that date.
We do not offer refunds for partial subscription periods except where required by applicable law.
4. Acceptable use
You agree to use GardenGenius only for its intended purpose: personal plant identification and garden management. You may not:
- Attempt to reverse-engineer, decompile, or tamper with the app
- Use the app in any way that could harm others or violate any law
- Share your account credentials with others
- Use automated scripts or bots to access the app
- Upload images that are not plant-related or that contain inappropriate content
5. Your data
Your garden data belongs to you. We do not claim ownership of any photos you take or information you enter into GardenGenius. See our Privacy Policy for full details on how your data is handled.
6. Intellectual property
GardenGenius's app design, code, AI models, branding, and content are owned by Op Studio and protected by copyright. You may not reproduce, distribute, or create derivative works based on any part of the app without our written permission.
7. Limitation of liability
GardenGenius is provided "as is." To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the app, including any reliance on plant identification results. Our total liability for any claim arising from these terms will not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for any harm resulting from misidentification of toxic or dangerous plants.
8. Changes to the app
We may update, modify, or discontinue features of the app at any time. We will provide reasonable notice of significant changes through in-app notifications.
9. Governing law
These terms are governed by the laws of the jurisdiction in which Op Studio is incorporated. Any disputes will be resolved in the courts of that jurisdiction, or through binding arbitration where applicable.
